<p>As a divorced spouse, you may be eligible to receive Social Security benefits from your ex-spouse&#8217;s work record. However, before you can receive any help, there are requirements and criteria to meet. Here is what you need to know about social security benefits for divorced spouses in Florida.</p>
<h3>Collecting Social Security from your Ex&#8217;s Work Record</h3>
<p>If your ex-spouse is entitled to collect Social Security retirement or disability benefits, you may also be eligible to collect spousal benefits on their earning record. However, you can only collect spousal benefits from your ex-spouse&#8217;s social security if you meet specific criteria.</p>
<p>First of all, the marriage should have lasted at least ten years. Following your divorce, you should not have remarried. You don&#8217;t necessarily have to be single: you just can&#8217;t be legally married. You will lose eligibility to collect benefits if you remarry while receiving benefits based on your ex-spouse&#8217;s entitlement. Lastly, you must be 62 years old when you apply for spousal benefits.</p>
<p>At the minimum required age of 62, you may be able to receive 32.5% of your ex-spouse&#8217;s benefits, regardless of whether or not they applied for benefits as well. The highest you can receive is 50% of their benefits, as long as you&#8217;ve reached retirement age, which will be at some point 67 years old. Social Security benefit rules are complex.</p>
<p>Don&#8217;t expect to receive combined benefits. You can still claim ex-spousal benefits even if you already receive retirement benefits on your work records. However, if you file for ex-spousal benefits, Social Security will only pay whichever of the two amounts are higher.</p>
<p><strong>Survivor Benefits</strong></p>
<p>If your ex-spouse is deceased, you may be entitled to survivor benefits, which involve receiving 100% of the amount your ex-spouse was eligible to receive if they never claimed benefits. It&#8217;s worth noting that any benefits you receive from your ex&#8217;s work record will not affect the benefits paid out to them by Social Security; it will also have no impact on their current spouse, assuming they remarried.</p>
<h3>How to Apply for Social Security Benefits</h3>
<p>To file for spousal benefits, you can visit the Social Security Administration (SSA) office or file online on their official website. You are not required to inform your ex-spouse of the application, as it will not affect any of their social security credits. You will have to provide the following requirements:</p>
<ul>
<li>Birth Certificate or any legitimate confirmations of your birth details</li>
<li>Official proof of citizenship or legal immigration status</li>
<li>Ex-Spouse&#8217;s Social Security Number</li>
<li>Marriage Certificate</li>
<li>Divorce Decree</li>

<p>The divorce process can be difficult for many people, but it can also be confusing. One aspect of divorce that is often misunderstood is alimony. What does the judge look at when determining alimony? How much will you get if you are awarded alimony, and what are some things to consider as part of divorce negotiations? To better understand how judges in Florida determine alimony, let’s discuss the different types of <a href="https://deboradiazlaw.com/factors-to-review-on-whether-to-seek-alimony-in-your-divorce/">alimony and the factors</a> affecting the court’s decision.</p>
<h3>Types of Alimony</h3>
<p>There are different types of alimony. Temporary alimony covers the time between divorce or separation, as well as divorce proceedings. There will need to be an end date when negotiating your settlement agreement; it can only last up until one party remarries or cohabits with someone else (in other words, they may get less money) unless the parties agree otherwise.</p>
<p>You might want <a href="https://deboradiazlaw.com/how-to-achieve-a-modification-of-alimony/">temporary alimony</a> if you do not have any means of supporting yourself while going through divorce proceedings and need more time to find a job following divorce. Permanent alimony is only proper when the evidence shows a permanent inability of the ex-spouse to become self-sustaining. Permanent alimony is typically only awarded upon the divorce of a long-term marriage which is defined as a marriage lasting 17 years or more.</p>
<h3>Factors That Determine Alimony</h3>
<p>Florida divorce laws are not as rigid as some other states, and the judge will have a lot of discretion in awarding alimony. Many factors determine how much alimony one party should be awarded to the other, such as length of the marriage, health, work history, and age.</p>
<p>For example, if one spouse is significantly older than the other, then they might get more alimony because they will need it for their retirement. Healthy spouses might not need alimony as much.</p>

<h3>Plan Ahead to Protect Your Assets</h3>
<p>It can be easy for one spouse to take advantage of the other. It is important to plan ahead of the divorce. That is why divorcing couples should consider taking legal steps before anything goes wrong with their relationship and all assets become shared property. Ways you can protect your assets include prenuptial agreements and <a href="https://deboradiazlaw.com/estate-planning-documents/">estate planning</a>.</p>
<p>If you are preparing for a divorce and have no prenuptial agreement in place, there are still things you can do to protect your assets from your soon-to-be-ex.</p>

<h3>Understand the Basics of Division of Marital Assets: Know what you are entitled to.</h3>
<h2><span style="font-size: 12pt;">In Florida, divorce proceedings are <a href="https://deboradiazlaw.com/florida-equitable-distributiondivorce/">equitable.  This </a>means that spouses will not be entitled to more than they would receive if the divorce had occurred without fault. </span></h2>
<p>The law on the division of marital assets means that divorce courts will not favor one spouse over another. The divorce proceedings are more or less a 50/50 split with some wiggle room for exceptions based on factors like adultery, mental abuse, etc.</p>
<p>Division of marital assets includes things such as property acquired during the marriage. These often include the house, car, investments, retirement accounts, and anything else acquired during the marriage. These are typically split evenly between spouses.  There are some exceptions for things like divorce settlements or agreements reached before divorce proceedings began.</p>
<p>The divorce process also includes other assets, such as pension plans and retirement accounts. That said, it is essential to know what you&#8217;re entitled to in a divorce before negotiating the terms of such with your spouse. In Florida, both parties must agree about how to divide these types of assets.</p>

<p><strong>How to Achieve a <a href="https://deboradiazlaw.com/alimony-no-longer-tax-deductible-looming-deadline/">Modification of Alimony</a></strong></p>
<p>In order to have the <a href="https://deboradiazlaw.com/factors-to-review-on-whether-to-seek-alimony-in-your-divorce/">alimony</a> you are currently ordered to pay reduced or stopped altogether, you must file a petition.  This will allow for modification of your current alimony payments if the burden is met. If you believe you are eligible to stop paying alimony altogether, your attorney may file a Petition for Abatement. Your petition will be filed in court.  Depending on the rules of your local court, a modification may reopen your prior divorce case.  You may be required to institute a new action.</p>
<p>To reopen your original divorce case, your attorney may use the case number from your original divorce as well as the same style of heading.</p>
<p>If it is for a new case, you are petitioning the court for a modification of alimony and your former spouse is responding to that petition.</p>
<p>You will receive a new case number and will probably pay a filing fee.</p>
<h2>Process</h2>
<p>Your petition may be served on your ex through a process server or through a law enforcement official in your county. When the petition is served, a Return of Service will be issued, providing a record of when your ex-spouse was served. At this point, the receiving spouse has the right to file an answer to your petition or a counter-petition.  Then your attorney will be required to file an answer to the counter-petition, on your behalf.</p>
<h2><a href="https://deboradiazlaw.com/what-is-mandatory-disclosure-in-florida-divorce/">Mandatory Disclosure</a></h2>
<p>You will be required to produce <a href="https://deboradiazlaw.com/what-is-mandatory-disclosure-in-florida-divorce/">financial disclosure documents</a> to prove your case. You may have to produce bank statements, pay stubs, any other proof of income, or notice of a lay-off (if this is your reason for requesting a modification).</p>
<p><strong>False Information Provided By Your Ex During the Divorce</strong></p>
<p>If you are filing for a modification or abatement of alimony based on the fact that your spouse provided false information during the divorce which resulted in the alimony award, you will be required to produce documentation to prove such fraud. For claims of fraud, there is a specific time limit for filing for a modification of alimony.</p>
<h3>Burden</h3>
<p>The Florida courts require that to obtain a modification of alimony there must be a substantial change in circumstances since the original order of alimony.  This change in circumstances was not contemplated during the original proceedings and the change is “sufficient, material, involuntary and permanent in nature.”</p>
<p><strong>Is a Decreased Ability to Pay Sufficient to Warrant a Modification of Alimony?</strong></p>
<p>A decreased ability to pay may justify alimony modification so long as it is not voluntary, and it appears the change is more than short-term. In 1992, the Florida Supreme Court held that voluntary retirement on the part of the spouse paying alimony could be considered a change of circumstances that warranted reduction or termination of alimony. While the court did not specifically address the “allowable” age of retirement, they did indicate that retirement prior to age 65 would likely be presumed unreasonable. An improvement of the economic situation on the part of the receiving spouse may or may not warrant a modification of alimony.</p>
<h3><a href="https://deboradiazlaw.com/factors-to-review-on-whether-to-seek-alimony-in-your-divorce/">Alimony Factors</a></h3>
<p>The circumstances of both parties will be scrutinized to determine whether a reduction in alimony is justified. Suppose the receiving spouse’s income increased significantly, but so, too, did the paying spouse’s income. In such a situation, the court might not agree to a modification. On the other hand, if the paying spouse was making $60,000 per year at the time of the divorce while the receiving spouse was making $15,000, yet five years later the paying spouse was still making $60,000 per year while the receiving spouse was bringing in $45,000, this could be reason enough for the courts to approve a modification of alimony award.</p>
<p>Income is not the only factor; gifts, inheritance, and lottery winnings may also be considered when determining the outcome of a modification of alimony. Increased need—on its own—may not qualify for an increase in alimony, and expenses related to a subsequent marriage will also not support a modification of alimony.  If you are considering a modification of alimony it is recommended to consult with an experienced family law attorney to discuss the applicable law and all of your options.</p>

<p>In cases of <a href="https://deboradiazlaw.com/family-marital-law/">marriage dissolution</a> or petition for paternity, parents who will share time with their minor child or children are required by Florida law to have a written parenting plan. For it to be approved by the court, it must detail a plan of how the parents will share responsibilities in daily parenting tasks, health care, school-related matters, and other activities. The <a href="https://deboradiazlaw.com/creating-a-good-parenting-plan-for-your-kids-after-divorce/">parenting plan</a> should also outline the child’s time-sharing schedule and the communication methods and technologies that the parents will use to communicate with each other and the child.</p>
<p>However, when it comes to the negotiation and agreement of shared parental responsibility and time-sharing/parenting time in a child custody matter, decisions are not made by whichever parent or primary caregiver has spent the most time with the child. While they may feel they know the child best, a judge ultimately makes decisions in child custody disputes using the “best interests of the child” as the primary consideration <strong>if</strong> the parties are not in agreement.</p>
<p><strong>What does “best interests of the child” in Florida mean? </strong></p>
<p><a href="http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&amp;Search_String=&amp;URL=0000-0099/0061/Sections/0061.13.html">Florida Statute 61.13(3)</a> provides a list of 20 factors to help determine “the best interests of the child.” The judge may consider any factor that is relevant to the individual situation. The 20 factors can be categorized under the demonstrated capacity and disposition of each parent to fulfill parenting responsibilities, the health and safety of the child, the child’s emotional and developmental needs, and the moral fitness of each parent. Here is a summary of the 20 factors:</p>
<ol>
<li>Demonstrated capacity and disposition to honor the time-sharing schedule and maintain a close parent-child relationship</li>
<li>The anticipated division of parental responsibilities</li>
<li>Demonstrated capacity and disposition of each parent to act upon the needs of the child</li>
<li>Length of time the child has lived in a stable environment</li>
<li>Geographic viability of the parenting plan</li>
<li>Moral fitness of the parents</li>
<li>Mental and physical health of the parents</li>
<li>The child’s home, school, and community record</li>
<li>The child’s preference</li>
<li>Demonstrated knowledge of each parent to be informed and involved in the child’s life, including knowing the child’s friends, daily activities, and favorite things</li>
<li>Demonstrated capacity of each parent to provide a consistent routine</li>
<li>Demonstrated capacity of each parent to communicate with the other parent</li>
<li>Evidence of domestic violence, sexual violence, child abuse, child abandonment, or child neglect</li>
<li>Evidence that either parent has knowingly provided false information to the court</li>
<li>The extent of the parenting tasks performed by each parent</li>
<li>Demonstrated capacity of each parent to be involved in the child’s school and extracurricular activities</li>
<li>Demonstrated capacity of each parent to maintain a substance-free environment for the child</li>
<li>The capacity of each parent to protect the child from ongoing litigation</li>
<li>Demonstrated capacity of each parent to meet the child’s developmental needs</li>
<li>Any other factors relevant to the parenting plan, including the time-sharing schedule.</li>
</ol>
<p><strong>What Happens if Parties do not Reach Agreement? </strong></p>
<p>I must stress that if the parties cannot reach an agreement on shared parental responsibility and time-sharing ultimately, the judge will determine parenting arrangements in child custody cases based on the “best interests of the child,” giving weight to parents who have demonstrated capacity and disposition to also put the child’s best interests first.</p>
